1. Agreement to these terms
These Terms & Conditions (the “Terms”) form a binding agreement between you and Glee (“Glee”, “we”, “us”), the operator of the Glee mobile application and the website at gleefolder.com.
By downloading the app, creating an account, or buying a ticket or booking through the Service, you confirm that you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
Nothing in these Terms excludes or limits any right you have under the Consumer Protection Act, 2012 or any other Kenyan law that cannot be excluded by agreement.
2. Definitions
- “Service” — the Glee app, the Glee website, and all related features.
- “Event” — any club night, concert, festival, party or other experience listed on the Service.
- “Organiser” — the promoter, venue, club, artist or other third party that produces, hosts and is responsible for an Event.
- “Ticket” — the digital pass, code or QR code issued through the Service granting admission to an Event.
- “Booking” — a table reservation, guest list entry or membership purchased through the Service.
- “you” — the person using the Service or buying a Ticket or Booking.
3. Eligibility (18+)
You must be at least 18 years old to use the Service. Glee lists licensed nightlife venues and events at which alcohol is sold, and the Alcoholic Drinks Control Act, 2010 prohibits the sale of alcoholic drinks to persons under 18.
By using the Service you represent that you are 18 or over and legally capable of entering into a binding contract. We may refuse or cancel any account or purchase where we reasonably believe this is not true, and will refund the purchase price in that case.
Individual Events may set a higher minimum age. Where an Organiser does so, that age applies and is stated on the Event listing.
4. Your account
You can buy some Tickets as a guest without an account. Where you do create one:
- You must give accurate, current and complete information — in particular a valid email address and phone number, since that is how we deliver your Ticket.
- You are responsible for keeping your credentials confidential and for all activity under your account. Tell us immediately at support@glee.com if you suspect unauthorised use.
- You may not create an account on behalf of someone else without their authority, or maintain multiple accounts to circumvent purchase limits.
- You may delete your account at any time — in the app under Profile → Settings → Delete account, or via our account deletion page.
5. Our role
Glee is a discovery and ticketing platform, not the Organiser of the Events listed. Unless an Event listing expressly states that Glee is the Organiser, we act as a disclosed agent for the Organiser in selling Tickets and taking Bookings.
This means:
- The Organiser is responsible for the Event itself — its line-up, timing, venue, capacity, safety, security, licensing and the experience on the night.
- Your contract for admission to the Event is with the Organiser. Your contract with Glee is for the ticketing service.
- Event information — line-ups, times, prices, images and descriptions — is supplied by Organisers. We take reasonable care in presenting it but cannot guarantee it is accurate, complete or unchanged.
- Where Glee is expressly named as the Organiser of an Event, we assume the Organiser’s responsibilities for that Event.
6. Tickets
- A Ticket is a revocable licence to attend the Event it names, subject to these Terms and the Organiser’s and venue’s conditions of entry. It is not a transfer of any other right.
- Each Ticket admits one person once. The QR code is invalidated when first scanned. If a duplicate is presented, the first valid scan wins and later holders will be refused entry without refund.
- Do not share screenshots of your Ticket publicly or with anyone you do not trust. We are not liable where someone else uses a Ticket you disclosed.
- Resale is prohibited. Tickets may not be resold at above face value, offered as a prize, or used for advertising or commercial purposes without our prior written consent. Tickets we reasonably believe have been resold in breach of this clause may be cancelled without refund.
- Your order is only confirmed once payment has been successfully authorised and we have issued you a Ticket by email, SMS or in the app. Adding items to a cart or starting a payment does not create a contract.
- We may set limits on the number of Tickets one person or household may buy, and may cancel orders that exceed those limits.
- If a Ticket is issued at the wrong price because of an obvious error in a listing, we may cancel it and refund you in full rather than honour the mistaken price.
7. Pricing, fees & payment
- All prices are shown in Kenya Shillings (KES) and, where applicable, are inclusive of Value Added Tax at the prevailing rate.
- Booking and service fees charged by Glee are shown separately at checkout before you pay. These fees cover the ticketing service and are, unless stated otherwise, non-refundable even where the face value of a Ticket is refunded.
- Payments are processed by Paystack. By paying you also accept Paystack’s terms. Glee does not receive or store your card number, CVV, PIN or mobile-money credentials.
- You must use a payment method you are authorised to use. Your bank or mobile-money provider may apply its own charges, which are your responsibility.
- If a payment fails, is reversed, or is charged back after a Ticket has been issued, we may cancel the Ticket and refuse admission, and may recover from you any fee our payment processor charges us in respect of that reversal.
8. Cancellations & refunds
Tickets are non-refundable and non-exchangeable once issued, except in the circumstances set out below or where the law requires otherwise. Because a Ticket is for a leisure event supplied on a specific date, you do not have a general right to change your mind after purchase.
You are entitled to a refund where:
- The Event is cancelled and not rescheduled — you will be refunded the face value of your Ticket.
- The Event is rescheduled or the venue moves — your Ticket normally remains valid for the new date or venue. If you cannot attend, you may request a refund of the face value within 14 days of us notifying you of the change.
- The Event is materially different from what was advertised — for example, the headline act billed on the listing does not perform — you may request a refund of the face value within 14 days of the Event.
- You were charged in error, or charged twice for the same Ticket — contact us and we will refund the full amount including fees.
No refund is due where you simply do not attend, arrive after last entry, are refused entry or ejected for breaching the venue’s conditions (including intoxication, lack of valid ID or failure to meet the dress code), or where a support act, set time or non-headline element of the line-up changes.
Where the Organiser holds the funds, refunds depend on the Organiser releasing them. We will pursue the Organiser on your behalf and keep you updated, but Glee is not the guarantor of an Organiser’s refund obligation except where Glee is named as the Organiser.
Approved refunds are made to the original payment method within 14 working days of approval. Your bank or mobile-money provider may take longer to post the funds.
To request a refund, email support@glee.com with your order reference.
9. Tables, guest lists & memberships
- A table booking reserves a table at the venue for the stated party size and time. Minimum spend, bottle-service and arrival-time conditions set by the venue apply and are shown before you confirm.
- Deposits paid on a table booking are applied to your minimum spend on the night. If you do not arrive by the stated arrival cut-off, the venue may release your table and your deposit may be forfeited.
- Guest-list entries are subject to venue capacity and are not guaranteed admission once a venue reaches capacity.
- Memberships run for the period stated at purchase and, where recurring, renew automatically until you cancel. You may cancel at any time before the next renewal date, in the app or by emailing support; cancellation stops future charges and does not refund the current period. Membership benefits depend on partner venues and may change; we will give notice of material changes.
10. Entry to events
By attending an Event you accept that:
- You must present a valid Ticket and, where asked, government-issued photo ID proving you are 18 or over.
- Admission is at the discretion of the venue and the Organiser. They may refuse entry or eject you for intoxication, abusive or violent behaviour, possession of prohibited items, breach of the dress code, or on reasonable safety grounds. No refund is due in these cases.
- You may be subject to search on entry, and to CCTV and security procedures operated by the venue.
- Events may involve loud music, strobe and laser lighting, crowds and smoke effects. You attend at your own risk and are responsible for assessing whether an Event is suitable for you, including any medical condition such as photosensitive epilepsy.
- Events are commonly filmed and photographed. By attending you consent to being included in general audience footage and images that the Organiser may use for promotional purposes.
- You are responsible for your own property and for getting home safely.
11. Acceptable use
You must not:
- Use the Service for any unlawful purpose, or in breach of the Computer Misuse and Cybercrimes Act, 2018.
- Use bots, scrapers, or automated tools to access the Service, buy Tickets, or harvest data from it.
- Forge, duplicate, tamper with or attempt to reuse a Ticket or QR code.
- Attempt to gain unauthorised access to our systems, probe them for vulnerabilities, or interfere with their operation.
- Impersonate another person, or use another person’s payment method without authority.
- Post content that is unlawful, defamatory, obscene, harassing, hateful or infringes anyone’s rights.
- Resell, sublicense, or commercially exploit the Service or its content without our written consent.
12. Content & intellectual property
The Glee name, logo, app, website, design, text, graphics and software are owned by Glee or its licensors and are protected by the Copyright Act, 2001, the Trade Marks Act and other intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for your own non-commercial use. All other rights are reserved.
Event artwork, artist names and venue marks belong to their respective owners and are used with permission for the purpose of listing the Event.
If you submit reviews, photos or other content to the Service, you keep ownership of it but grant Glee a worldwide, royalty-free, non-exclusive licence to host, reproduce and display it in connection with operating and promoting the Service. You confirm you have the rights to grant that licence. We may remove content that breaches these Terms.
13. Third-party services
The Service links to and depends on third parties — Organisers, venues, Paystack, app stores, and mapping and messaging providers. We do not control them and are not responsible for their content, products, or practices. Your use of a third-party service is governed by that party’s own terms.
If you downloaded the Glee app from Google Play or the Apple App Store, that store’s terms also apply to your download and use of the app. Google and Apple are not parties to these Terms and have no responsibility for the Service.
14. Availability & disclaimers
We work to keep the Service available and accurate, but we provide it “as is” and “as available”. To the fullest extent permitted by law, and without affecting your statutory rights as a consumer, we do not warrant that the Service will be uninterrupted, error-free, secure, or that any Event will take place as advertised.
We may suspend, withdraw or restrict all or part of the Service for maintenance or business reasons. We will give notice where reasonably possible.
15. Limitation of liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited — including your rights under the Consumer Protection Act, 2012.
Subject to that:
- We are not liable for loss or damage caused by an Organiser or venue, including cancellation, changes to the line-up, the standard of the Event, or anything that happens to you at an Event — except where Glee is expressly named as the Organiser.
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, opportunity, data or anticipated savings.
- We are not liable for travel, accommodation or other costs you incur in connection with an Event that is cancelled, rescheduled or moved. You are strongly advised to buy refundable travel arrangements or insurance for Events involving significant travel.
- Our total liability to you arising out of or in connection with a transaction is limited to the total amount you paid to Glee for that transaction.
We are not liable for failure to perform caused by events outside our reasonable control, including natural disaster, epidemic, fire, adverse weather, civil unrest, strike, terrorism, government or licensing action, or failure of power or telecommunications networks.
16. Indemnity
You agree to indemnify Glee and its directors, employees and agents against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your unlawful conduct, or your conduct at an Event.
17. Suspension & termination
We may suspend or terminate your access to the Service, and cancel Tickets without refund, if we reasonably believe you have breached these Terms — in particular by touting Tickets, forging or duplicating a Ticket, committing payment fraud, or behaving abusively toward our staff, an Organiser, venue staff or other attendees.
You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination — including sections 12, 15, 16 and 19 — continue to apply.
18. Changes to these terms
We may update these Terms as our Service and the law change. The “last updated” date at the top shows the current version. If we make a material change we will give reasonable notice by email or in the app before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
The version of the Terms in force when you buy a Ticket governs that purchase.
19. Governing law & disputes
These Terms and any dispute arising out of them or the Service are governed by the laws of the Republic of Kenya.
If you have a complaint, please contact support@glee.com first — we aim to acknowledge within 2 working days and resolve within 14. If we cannot resolve it, the parties will first attempt negotiation in good faith.
Any dispute that is not resolved that way is subject to the exclusive jurisdiction of the courts of Kenya, sitting at Nairobi. If you are a consumer resident outside Kenya, this does not deprive you of the protection of mandatory consumer laws in your country of residence.
20. General
- Entire agreement — these Terms and the Privacy Policy are the whole agreement between you and Glee regarding the Service.
- Severability — if any provision is found unenforceable, the rest remain in force.
- No waiver — if we do not enforce a right immediately, we do not give it up.
- Assignment — you may not assign your rights under these Terms without our consent. We may assign ours to a successor in connection with a merger, acquisition or sale of assets.
- Third parties — no one other than you and Glee has any right to enforce these Terms.
